The Department of Buildings issued an active Environmental Control Board violation this week against a home renovation site at 963 Forest Hill Road in Staten Island.
Per DOB records, the violation (ECB number 39559976M) was served September 30 against respondent listed as "Stream Rock Contsruction" for the construction fence surrounding the site of an alteration to a two-story family dwelling.
The violation describes the job site fence as not constructed to code: inspectors found the main front gate and entrance door hinged to swing outward rather than inward, which the citation states is not permitted under the applicable fence subsection.
DOB classified the violation as Class 2 and non-aggravated, with a $1,000 penalty imposed and the full balance still due as of this writing. A hearing is scheduled for December 8 at 8:30 a.m.
Fence violations like this one are common on active renovation sites, but they're not nothing: a construction fence is one of the basic protections DOB requires to keep a job site secured from the sidewalk, and an outward-swinging gate can push into pedestrian right-of-way. The citation falls under BC 3307.7 and Administrative Code 27-1021(c), the sections governing how job site fencing must be built and maintained.
Separately, DOB's complaint system logged 100 new construction-related complaints citywide over the past two days, spanning all five boroughs — a normal volume for the system, not evidence of any single pattern, and none of those complaints are confirmed violations on their own.
For contractors: if your site fence has outward-swinging gates or doors, fix it before a DOB sweep finds it — this is a cheap, avoidable violation. The property owner or contractor of record can review the violation and penalty status on DOB NOW or through the ECB violation lookup, and can contest or pay ahead of the December 8 hearing.
