A batch of OATH/ECB hearings decided October 29 found eleven respondents "in violation" on Department of Buildings charges ranging from work without a permit to failure to maintain an elevator, according to OATH/ECB Hearings (Case Status) records.
At 188 East 64 Street in Manhattan, Rockledge Scaffold Corp was found in violation and penalized $2,400 after DOB records describe a sidewalk shed with "defective mudsills, damaged parapet wall and unsecured cross bracing" that inspectors found did not meet pedestrian-protection code. The underlying violation was dated August 19.
At 93 Crosby Street in Manhattan, the 93 Crosby St Condominium was fined $1,250 after DOB records describe an out-of-service elevator at the time of inspection, cited under the department's elevator-maintenance code.
Several of the week's decisions involve the same recurring charge: failure to file a certificate of correction for an earlier violation. That pattern hit 28th Street Properties LLC at 136 West 28 Street ($1,250), Hello Flatbush LLC at 1357 Flatbush Avenue in Brooklyn ($1,250), BSC Housing Company Inc at 186 Vandalia Avenue in Brooklyn ($1,250), and 47th Hotel Associates LLC at 128 West 47 Street, which drew two separate penalties totaling $3,750 for uncorrected 2022 violations covering work without a permit and an occupancy-contrary-to-certificate issue.
Tenrit Studios Inc, at 55 West 110 Street in Manhattan, was fined $2,500 across two tickets — one for work without a permit covering unpermitted gas bypass work in the basement, the other for building-maintenance violations that DOB records describe as including damaged sprinkler heads and a backward-installed sprinkler head in the basement.
Smaller penalties went to 12th Americas Company LLC at 478 Avenue of the Americas ($250, for an unpermitted retractable awning), Dee Dee Chambers STINC Dee at 79 Reade Street ($625), Chad-Erick Chinatownetc Hassan at 121 Baxter Street ($625, for unpermitted gas-fired water heaters), and DNY, 434-436 East 76 LLC at 434 East 76 Street ($1,250, for illegal SRO partitions cited by DOB records).
OATH's case-status data lists all eleven matters as "Penalty Due" with no payment yet recorded as of this writing. The hearings were decided by phone through OATH's Manhattan summons adjudication unit.
