The New York City Department of Buildings issued a partial stop-work order this week at 3807 Avenue P in Brooklyn after an inspector found missing guardrails and toe boards on three sides of an active construction site, according to an ECB violation filed against Palace Housing Corp. The violation, numbered 39560854M, was issued October 21 and cites Building Code section 3304.4.4. The inspector's notes, entered into the city's ECB Violations dataset, describe the missing guardrails along exposures 1, 2 and 4 as creating "severe fatal fall hazards for any persons entering work site." The violation carries a Class 2 severity rating and a $2,500 penalty, with a hearing scheduled for January 6, 2027.

At a separate site in Flushing, Queens, DOB records show the department cited a contractor identified as Excellent Metropolitan twice on October 21 for failing to communicate safety information to workers at 157-59 Rose Avenue. One violation, 39560881H, states an inspector found four Spanish-speaking workers on site whose orientation log contained only three completed orientation forms; the last worker, according to the violation, "was given a English only page." A second violation at the same address and same date, 39560883L, states pre-shift safety pages for the site's workers "had worker signatures, but there was no safety instructions, or work details indicated." Both are Class 1 violations carrying $5,000 penalties each, with hearings set for December 29.

In Staten Island, DOB cited Project Eye Consultants I at 2096 Clove Road for a construction fence that the inspector found did not meet code and lacked the required viewing panels for "clear visual access," per the violation record (39560879Z, Class 2, $1,000 penalty, hearing January 6). In Brooklyn, an inspector cited Rainspring Gardens Condominium at 929 40th Street (near New Utrecht Avenue) for a corrugated metal decking platform permanently affixed to the fourth floor with no permit on file, a work-without-a-permit violation (39208718P, Class 1, $2,500 penalty).

DOB also cited Arkenstone Builders Inc. at a Nesconset-listed address tied to BIN 3081538 in Brooklyn for an unguarded floor opening on the fourth floor during metal-stud framing work, with a worker observed installing a balcony outside the structure with what the inspector called "inadequate" protection (39560877P, Class 2, $5,000 penalty, hearing January 6). None of the violations in this batch indicate an injury occurred; all remain pending before the Environmental Control Board as of this writing, per DOB records.

Separately, DOB's complaint intake logged roughly 100 new construction, elevator and boiler-related complaints citywide over the past two days, including elevator-safety complaints in Williamsburg, Long Island City, and the Bronx. A complaint is an unverified report and does not by itself establish a violation; none of the complaints in that batch are tied to the violations above.
