The bulk of this week's new DOB ECB violations, issued October 9 and 12 across all five boroughs, trace to one recurring problem: sidewalk sheds and construction fences running on expired permits, or not meeting code in the first place.
At 32-04 146th Street in Flushing, Queens (BIN 4008947), PSD Management LLC was cited after inspectors found a sidewalk shed still up under a permit that expired August 26. The violation, issued under Administrative Code 28-105.1, carries a $1,250 penalty. A near-identical violation hit Pistilli Associates-1 at 35-01 30th Avenue in Long Island City (BIN 4008196), where a shed permit expired September 22 — also $1,250.
At 5676 Riverdale Avenue in the Bronx (BIN 2017175), respondent listed as C/O Chestnut Holdings of was cited twice in the same inspection: once for a sidewalk shed with decking not fully extended, leaving gaps and missing underside coverage over a public walkway ($2,400, under Building Code 3307.6), and once for bricks and equipment stored on top of that same shed, a falling-object hazard under Building Code 3301.2 ($2,500).
At 43 East 16th Street in Brooklyn (BIN 3023085), Brooklyn Third Avenue LLC was cited after inspectors found a shed's vertical leg members out of plumb — per DOB records, "putting sidewalk shed in danger of collapsing" — a $2,400 violation under the same shed-code section.
Staten Island got its own version at 11 Kermit Avenue (BIN 5175345), where V&V Development Corp was cited $1,000 for a construction fence DOB records describe as in a state of disrepair and not code-compliant.
Two more permit-expiration violations round out the pattern: 3447 Hylan Boulevard in Staten Island (BIN 5056477, MZM Construction Service), where a fence permit expired in May, and 1210 Croes Ave in the Bronx (BIN 2024145, respondent 1210 Croes LLC), where inspectors found no active work on a 20-story building alteration and a sidewalk shed permit that had also lapsed.
Separately, at 3121 Ocean Avenue in Brooklyn (BIN 1030860), V A N Construction Corp drew three violations in one visit: standing water in an active excavation during foundation work, an office trailer installed without appearing on the approved site safety plan, and a hose crossing the public sidewalk without protective covering. Penalties ran $1,250 to $2,500 per ticket.
All violations here are Class 2, listed ACTIVE, with hearings scheduled between December 15 and December 22; none show any penalty paid yet. For contractors working near any of these addresses or bidding GCs on the list, the lesson is the boring one: shed and fence permits lapse quietly, and DOB is checking expiration dates as closely as it checks the hardware itself.
