The Department of Buildings served a cluster of Environmental Control Board violations on October 28, according to DOB ECB records, most involving sidewalk shed conditions, work performed without a permit, or buildings cited for failing to maintain code-compliant equipment.
Three separate violations target sidewalk sheds with unlit undersides, which DOB inspectors describe as creating dark, unsafe pedestrian conditions under Building Code 3307.6.4.8: at 2224 Avenue O in Brooklyn (respondent Kay Waterproofing Corp, BIN 3329459); at 445 5th Avenue in Manhattan (respondent Michael Dardia New York, BIN 2041911, cited twice — once for the unlit shed and once for a defective lighting condition observed at 5 a.m. carrying a $6,000 penalty); and at 15 Swan Street on Staten Island (respondent K E S Construction Co Inc, BIN 3321834), where the inspector also noted loose debris netting, missing bolt covers and rotten base plates on a 19-story building's shed.
Unpermitted work accounts for several more. At 1416 East 34 Street in Brooklyn, respondent Donat Masha L was cited for demolition and removal of a residential garage with no permit on file, a $5,000 Class 1 violation, and separately for a tarp-wrapped scaffold DOB called an unsafe condition. At 103 West 120 Street in Manhattan, Quasar Realty Partners LLC was cited after inspectors found a supported scaffold on a building under facade repair with a permit that had expired since late September. At 2467 East 12 Street in Brooklyn, 2467 E12 LLC was cited for a temporary electrical service mast and active outlets with no permit on file and extension cords plugged in.
In the Bronx, 26 FCP LLC c/o LAL Prop was cited at 3190 Riverdale Avenue for a Weil McLain gas-fired boiler found with exposed wiring, a missing coil relief valve and temperature gauge, and a defective barometric damper — a $1,250 Class 2 violation under the city's equipment-maintenance code. Also in Brooklyn, Prime Construction's record (above) aside, a separate construction-site housekeeping violation hit SMBT LLC at 1538 Ocean Parkway for combustible debris piled along two exposures of a closed three-story construction site, and Buildwise Construction Group drew two violations at 94 Avenue U for unapproved roof dormers and a construction extension, plus a debris pile.
All violations listed carry ACTIVE status with hearings pending between January 5 and January 15, 2027, per DOB ECB records. None of the respondents' responses are part of the public filing reviewed.
Separately, DOB's complaint intake shows roughly 100 new complaints logged October 29–30 across the boroughs, including a cluster of five linked complaints at adjoining addresses on 111 Street in South Richmond Hill, Queens, and several elevator-related complaints in the Bronx. A complaint is an unverified request for inspection, not a finding, and none of these have a violation attached yet.
What to do next
If your crew is running a sidewalk shed on an active job, check the lighting at every exposure before an inspector does — three separate citations this week came from the same code section, BC 3307.6.4.8, and penalties ran $2,400 to $6,000 per violation. If you're pulling permits adjacent to any of the addresses above, a quick BIS search on the BIN will show whether the expired permit or open SWO issue has been resolved before you price the job.
