DOB issued a cluster of new ECB violations dated September 29 that share a theme: construction happening without the paperwork to back it up, found in cellars, behind fences, and under scaffolding from Brooklyn to Queens.

At 30-38 86 Street in East Elmhurst, Queens (BIN 4167027), inspectors cited respondent Avtar Singh for failing to correct a prior violation — issued back in April 2025 — covering water and waste line work for a cellar bathroom installed without a permit. Per DOB records, no permits, appointments, or correction proof had been filed. The Class 2 violation carries a $1,250 penalty.

At 888 Ocean Avenue in Brooklyn (BIN 3029660), 327 Eastern Parkway LLC picked up two separate violations the same day: one for unpermitted plumbing work — a new bathroom and commercial kitchen sink in the cellar — and another for unpermitted framing that DOB says created storage space, a kitchen, and a connecting staircase between the cellar and a first-floor apartment. Each carries a $1,250 penalty, for $2,500 total at the address.

In Fresh Meadows, Queens, DOB cited Yafit Firgiyeva at 73-11 194 Street (BIN 4154357) for an unpermitted metal-and-glass structure — roughly 10 feet wide, 32 feet long, and 10 feet high — attached to the building's exterior wall. The violation carries a $2,500 penalty.

In the Bronx, Md Arif Hosen was cited at 2163 Glebe Avenue (BIN 2041479) after an inspector reported a fully demolished first-floor facade, with new window and door openings and plywood staging underway — all, DOB says, without a permit on file. That violation carries a $2,500 penalty.

And in Flushing, Queens, at 69-29 59 Drive (BIN 4433767), Lucyna Marczak was cited after an inspector found a structural joist beam connecting a garage and entrance porch removed with no permit on record — serious enough that DOB paired the ECB violation with a partial stop-work order on top of the standard $1,250 fine.

Separately, DOB flagged ongoing site-safety lapses at a 12-story new-building project at 170 Nelson Road under construction for Durgaj Properties Corp (BIN 2131137) in the Bronx: three violations issued the same day cover an unpainted standpipe, missing debris netting on an open perimeter, and a concrete pump truck blocking a pedestrian walkway during an active pour on the 9th floor slab. Each carries a $2,500 penalty, for $7,500 in filings at a single active high-rise site.

All violations listed carry PENDING hearing status, with hearings scheduled between December 3 and December 9; none has been adjudicated. Source: NYC DOB ECB Violations dataset, records served September 29, 2026, accessible via NYC Open Data.

For contractors: a posted stop-work order, an expired permit, or an open cellar conversion are among the easiest things for a DOB inspector to catch on a routine pass — and per these records, the agency is catching them at a steady clip across every borough. If you're running a cellar buildout, a facade job, or any work adjacent to an active permit, confirm the paperwork matches what's actually happening on site before the next inspection does it for you.
